Welcome to Celestial Shift Therapy
These Terms of Use ("Terms") govern your access to and use of the Celestial Shift Therapy website and telehealth services. By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
1. Acceptance of Terms
By scheduling an appointment, attending a therapy session, or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional policies referenced herein.
2. Services Provided
Telehealth Therapy Services
Celestial Shift Therapy provides virtual mental health counseling services through secure, HIPAA-compliant telehealth platforms. Our services include:
Individual therapy for adults
LGBTQ+ affirming therapy
Trauma-informed care
BIPOC-centered mental health support
Treatment for anxiety, depression, life transitions, and relationship issues
Service Area
We are licensed to provide services to clients located in the State of Texas at the time of service.
Not Emergency Services
Our services are not designed for emergency mental health situations. If you are experiencing a mental health emergency, please:

3. Client Responsibilities
Eligibility
By using our services, you represent that you:
Are at least 18 years of age or have parental/guardian consent
Are physically located in Texas during all therapy sessions
Have the legal capacity to enter into this agreement
Will provide accurate and complete information
Session Requirements
You agree to:
Attend sessions from a private, confidential location
Use a secure internet connection
Test your technology before sessions
Arrive on time for scheduled appointments
Provide at least 48 hours notice for cancellations
Keep your contact information current
Prohibited Conduct
You agree not to:
Record therapy sessions without explicit written consent
Share your login credentials with others
Use services for any unlawful purpose
Misrepresent your identity or location
Harass, threaten, or abuse the therapist
Attempt to breach security measures
4. Scheduling and Cancellations
Appointment Scheduling
Appointments are scheduled through our approved booking systems or by direct communication with your therapist.
Cancellation Policy
You must provide at least 48 hours advance notice to cancel or reschedule an appointment
Late cancellations (less than 48 hours notice) or no-shows may be charged the full session fee
Exceptions may be made for emergencies at the therapist's discretion
Repeated late cancellations or no-shows may result in termination of services
Therapist Cancellations
If we need to cancel or reschedule, we will provide as much advance notice as possible and will not charge you for the missed session.
5. Fees and Payment
Session Fees
Current fees are discussed during the initial consultation. Fees are subject to change with 30 days written notice.
Payment Methods
We accept payment through:
Insurance (via Headway, Rula, and Tava)
Credit/debit cards
Other payment methods as agreed upon
Insurance
You are responsible for understanding your insurance benefits and coverage
You are responsible for any copays, deductibles, or non-covered services
Insurance claims are submitted on your behalf, but we cannot guarantee payment
If insurance denies a claim, you are responsible for the full fee
Non-Payment
Failure to pay for services may result in:
Suspension or termination of services
Referral to collections
Legal action to recover unpaid fees
6. Telehealth Consent and Limitations
Technology Requirements
You must have:
A device with camera and microphone capability
Reliable high-speed internet connection
A secure, private location for sessions
Updated browser or telehealth app
Limitations of Telehealth
You understand and acknowledge that:
Telehealth may not be appropriate for all mental health conditions
Technology failures may occasionally disrupt sessions
There are potential risks to privacy despite security measures
Physical examinations cannot be conducted remotely
The therapist may determine that in-person care is more appropriate
Technology Failures
If technical difficulties occur:
We will attempt to reconnect via the telehealth platform
If unable to reconnect, we will contact you by phone
Sessions interrupted for more than 15 minutes may be rescheduled
You will only be charged for the time completed
7. Confidentiality and Privacy
Your privacy is protected in accordance with HIPAA and Texas state law. Please review our Privacy Policy for detailed information. Confidentiality may be limited in situations involving:
Risk of harm to yourself or others
Suspected child or elder abuse
Court orders or legal proceedings
As otherwise required by law
8. Professional Boundaries
Therapeutic Relationship
The relationship between you and your therapist is professional and therapeutic in nature. We maintain strict professional boundaries to protect the integrity of the therapeutic relationship.
Outside Contact
Communication outside of scheduled sessions should be limited to scheduling and administrative matters
Your therapist is not available for crisis intervention between sessions
Social media connections and personal relationships outside of therapy are not permitted
9. Termination of Services
By Client
You may terminate services at any time. We encourage you to discuss termination with your therapist to ensure a proper conclusion to treatment.
By Therapist
We may terminate services if:
The therapeutic relationship is no longer beneficial
You repeatedly violate these Terms
You engage in threatening or abusive behavior
You fail to pay for services
Services outside our scope of practice are needed
You are not making adequate progress and would benefit from alternative treatment
If services are terminated, we will provide appropriate referrals when clinically indicated.
10. Intellectual Property
All content on the Celestial Shift Therapy website, including text, graphics, logos, and images, is the property of Celestial Shift Therapy, LLC and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without express written permission.
11. Website Use
Informational Purposes
Our website provides general information about our services. It is not intended to provide medical advice or create a therapist-client relationship.
Accuracy
While we strive to provide accurate information, we do not warrant that website content is complete, accurate, or current.
Third-Party Links
Our website may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of these external sites.
12. Disclaimer of Warranties
Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee:
Specific treatment outcomes
Uninterrupted or error-free services
That services will meet all your needs
That telehealth technology will function perfectly at all times
13. Limitation of Liability
To the fullest extent permitted by law, Celestial Shift Therapy, LLC, and Nicole Obih, LCSW, shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services, even if advised of the possibility of such damages.
Our total liability for any claims related to our services shall not exceed the amount you paid for services in the three months preceding the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless Celestial Shift Therapy, LLC, and Nicole Obih, LCSW, from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:
Your violation of these Terms
Your use of our services
Your violation of any rights of another party
15. Governing Law and Dispute Resolution
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
Dispute Resolution
Any disputes arising from these Terms or our services shall be resolved through:
Good faith negotiation between the parties
Mediation, if negotiation is unsuccessful
Binding arbitration in Harris County, Texas, if mediation fails
Litigation in the state or federal courts of Harris County, Texas, as a last resort
16. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated effective date. Continued use of our services after changes constitutes acceptance of the modified Terms. Material changes will be communicated directly to active clients.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Celestial Shift Therapy regarding use of our services.
